Competition Law

Competition Law is a law that promotes or seeks to maintain market competition by regulating anti-competitive conduct by companies. Competition law is implemented through public and private enforcement.

Competition and antitrust is a rapidly evolving area of law and economics. In South Africa, the competition authorities are increasingly aggressive in their investigation of mergers and prosecution of cartel conduct, abuse of dominance and launching of market inquiries, meaning that this practice area requires closer attention than ever. Substantial fines and damages claims are now a real possibility, and criminal penalties for individuals involved in cartel conduct are looming.
